Today, a Derbyshire police spokesman said: "After consultation with the Crown Prosecution Service (CPS), all those arrested have been released without charge and there will be no further action."
The police spokesman advised the DT to contact the CPS for further information so we have asked them why no further action will be taken.
After Mr Smith died, Barrow Hill resident Lousie Slater said: "He was a lovely bloke.
"He’d do anything for anyone.
